Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Pixel Pilgrim Studios LLC (“Pixel Pilgrim Studios,” “PPS,” “we,” “us,” “our”) websites, apps, and related services (collectively, the “Services”). By using the Services, you agree to these Terms.

1. Who we are

Pixel Pilgrim Studios LLC is a custom software and senior engineering studio. We also publish software products, including iOS applications that may support login and cloud sync.

2. Eligibility

You must be at least 13 years old to use the Services (or older where required by local law). If you are using the Services on behalf of an organization, you represent you have authority to bind that organization to these Terms.

3. Accounts

Some Apps and Services require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Do not share passwords. If you believe your account is compromised, contact us.

4. Cloud sync and availability

Certain features may require internet access and may store data on our servers or through cloud providers. We aim to keep the Services available, but we do not guarantee uninterrupted access and may perform maintenance, upgrades, or changes at any time.

5. Subscriptions and purchases

Some PPS Apps may introduce subscriptions in a future release. If subscriptions are not currently live in your app, you will not be charged. When subscriptions become available, pricing and billing terms will be presented in the App and/or App Store listing.

If/when subscriptions are offered through Apple’s App Store, billing, renewal, cancellation, and refunds are governed by Apple’s policies and your Apple account settings.

6. Acceptable use

You agree not to misuse the Services. This includes, but is not limited to:

Attempting to access, probe, or disrupt systems without authorization
Reverse engineering, decompiling, or attempting to extract source code except where permitted by law
Using the Services for unlawful, harmful, or abusive purposes
Uploading malware or attempting to interfere with the normal operation of the Services
Violating others’ intellectual property or privacy rights

7. User content

Some Services may allow you to submit, store, or share content (“User Content”). You retain ownership of your User Content. You grant PPS a limited license to host, store, and process User Content solely to provide and operate the Services, including cloud sync where enabled.

8. Intellectual property

The Services, including software, design, text, graphics, and trademarks, are owned by Pixel Pilgrim Studios LLC or its licensors and are protected by intellectual property laws. Except for the limited rights granted in these Terms, PPS reserves all rights.

9. Third-party services

The Services may integrate third-party services (for example, cloud hosting, analytics, authentication providers, or app stores). Your use of third-party services may be governed by their terms. PPS is not responsible for third-party services that we do not control.

10. Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, PPS disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. PPS does not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, PPS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from or related to your use of the Services.

To the maximum extent permitted by law, PPS’s total liability for any claim arising out of or related to the Services will not exceed the amount you paid to PPS for the Services in the 12 months before the event giving rise to the claim (or $100 if you paid nothing).

12. Indemnification

You agree to indemnify and hold harmless PPS from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate access to the Services if you violate these Terms or if we reasonably believe your use creates risk to PPS, other users, or third parties. You may stop using the Services at any time.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we may provide notice (for example, by updating the date on this page or providing an in-app notice). Continued use after changes become effective means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of California, United States, excluding conflict-of-law rules, subject to any mandatory consumer protections that apply in your jurisdiction.
